1. Company Information

2. Accounts & Security

  • Each User has a personal account, accessed via a username and password.
  • You are responsible for keeping your login details secure and all activity on your account.
  • Notify us immediately if you suspect unauthorised use.
  • We may suspend or terminate accounts where security is compromised or these Terms are breached.

3. User Responsibilities

  • You are solely responsible for the accuracy and legality of information you publish on the Site.
  • By uploading content (text, graphics, images, or other materials), you confirm you own it or have the right to use it, and that it does not infringe third-party rights.
  • You agree to keep your account details up to date.
  • All bookings made through the Site are contracts between you and your guests. Bookalet is not a party to these contracts and accepts no liability for their performance.

4. Service Availability

  • We aim to provide reliable service, but the Site may be unavailable at times due to maintenance, upgrades, internet issues, or events outside our control.
  • We’ll use reasonable efforts to restore access quickly, but we do not guarantee uninterrupted uptime.
  • We may improve, update, or modify the Site at any time.

5. Subscription & Payment

  • Bookalet is a subscription-based service. Fees are payable annually in advance unless agreed otherwise.
  • All new Users get a 30-day free trial before payment is required.
  • Once a subscription fee is paid, it is non-refundable. Refunds may be granted at our discretion and may be subject to a £25 administration fee.
  • If payment is not received, your account may be suspended or closed.

6. Intellectual Property

  • All rights in the Site and its technology remain with BnBSelect.com Ltd or our licensors.
  • You are granted a limited, non-transferable licence to use the Site for your business purposes only.
  • You may not copy, distribute, reverse engineer, or commercially exploit the Site without our written consent.

7. Data Protection & Privacy

  • You are the Data Controller for guest and booking data entered into the Site. We act as your Data Processor, handling personal data only to provide the service.
  • We may use anonymised or aggregated data for statistics and service improvements.
  • We process personal data in line with the UK GDPR and the Data Protection Act 2018. See our Privacy Policy for details.

8. Liability

  • We are not responsible for the accuracy of information published by Users, nor for disputes or liabilities arising between Users and their guests.
  • To the fullest extent permitted by law, we are not liable for:
    • loss of profits, revenue, or goodwill,
    • wasted staff time,
    • loss or corruption of data.
  • Our total liability to you for all claims in any 12-month period will not exceed the subscription fees you paid in that period.

9. Indemnity

You agree to indemnify and hold harmless BnBSelect.com Ltd against any claims, losses, or expenses arising from your use of the Site or breach of these Terms.

10. Termination & Data Retention

  • We may suspend or terminate your account if you breach these Terms, misuse the Site, or fail to pay fees.
  • You may cancel at any time, but no refunds will be issued except at our discretion (see section 5).
  • Free trial accounts that remain unpaid will be deleted after 6 months, and all data will be permanently removed.
  • Paid accounts that expire without renewal will be deleted after 12 months, and all data will be permanently removed.
  • Once an account is deleted, data is not recoverable.

11. Force Majeure

We are not liable for delays or failures caused by events beyond our reasonable control, including natural disasters, strikes, internet outages, or power failures.

12. Governing Law & Jurisdiction

These Terms are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
